Yes, a mediator can file divorce papers if they are an attorney. However, not all divorce mediators file divorce papers.
According to FindLaw, “If the mediator is an attorney, the attorney can assist the parties in filing all papers with the court, including starting the dissolution of marriage action, preparing and filing the necessary disclosure documents, and preparing the agreement, judgment, and final papers to be filed with the court”.
Typically, divorce mediators help write an agreement for you to file yourself. A mediator will explain how and when to file a divorce complaint. You have the option of filing yourself or hiring a lawyer to file for you.
According to Nolo, “Very often, family law mediation sessions involve just the divorcing spouses and the mediator. This keeps costs down and ensures that you and your spouse do the talking and make the decisions (lawyers have a tendency to take over when they are present)”.
Filing yourself will save the most money, but if you do not want the hassle of filing divorce papers, or do not want to hire a lawyer to file them for you, make sure to ask your potential mediator if they offer filing services.
However, you can still hire an attorney to review your divorce paperwork after mediation is complete. You can also have the attorney file the paperwork for you.
