Types of Divorce Mediation

There are 3 primary models of procedure utilized by divorce mediators. They are facilitative mediation, transformative mediation, and evaluative mediation. Mediators use a combination of all 3 models in a realistic, aspirational approach. Many mediators have discovered that this collective method works ideally to help couples communicate and come to a separation agreement. Nevertheless, there are mediators that adhere to only one of the 3 models of procedure of mediation, and you should be mindful of the differences between each one.

Facilitative Mediation

Facilitative mediation puts emphasis on a process in which you are actively involved in making the decisions that impact your lives. It involves methodically determining issues through cooperative communication. This type of divorce mediation is equally concentrated on helping you to communicate with each other and coming to a resolution or settlement. The facilitative mediator usually offers options but will not give opinions about the justness of a proposed agreement. The justness of the agreement is left up to you to decide on, instead of what may be conventional in court. Additionally, most facilitative mediators hold collective sessions, and seldom hold individual sessions.

Transformative Mediation

The objective of the transformative mediation blueprint is largely to accomplish a change in the style you communicate in and the way you deal with one another. The idea is to alter the relationship and is more emotionally purging than facilitative divorce mediation. The transformative mediator is more interested with each individual’s equality and recognition and transforming the quality of your interactions with each other than with pursuing a settlement. The transformative divorce mediation method seeks to positively change your interactions so that lasting change may happen as you establish your own way through the conflict.

Evaluative Mediation

Evaluative mediation is based off of a settlement meeting structure. The divorce mediator is going to assist in assessing the positions of you and offer essential knowledge and proficiency. In evaluative divorce mediation, the mediator may have separate or collective sessions with each of you and/or utilize compromise. Settlement is the initial goal of evaluative mediation and typically takes precedence over any process. Evaluative method mediators look at the cost benefit review and legal point of view of your positions whereas looking to promote a resolution of the matters.
